General Terms and Conditions of Sale
Preamble - Purpose of these General Terms and Conditions of Sale
The Seller ( SFAXITECHNOLOGY LIMITED )
Register Number: IE811139
publishes and operates a website accessible at the following web address www.10lapuff.com
(hereinafter the “Site”).
The Products are offered for sale on the Site to non-professional buyers and are as follows: electronic cigarettes, liquids and associated products.
These General Terms and Conditions of Sale (hereinafter the “General Terms and Conditions of Sale”) describe the terms and conditions governing the distance sale of products offered for sale (“the Products”) between the Sellers and non-professional buyers (“the Customers” or “the Customer”), through the aforementioned Website, and define the obligations and rights of the Parties in this respect.
By placing an order on the website www.10lapuff.com , the Customer fully and unconditionally agrees to these General Terms and Conditions of Sale, which the Customer expressly acknowledges, and waives, in particular, the right to invoke any contradictory document that would therefore be unenforceable against the Company ISFAX TECHNOLOGY LIMITED .
These General Terms and Conditions of Sale are available at any time on the Site and shall prevail, where applicable, over any other version or contradictory document. As these General Terms and Conditions of Sale may be amended subsequently, the version applicable to the Customer's purchase is the version in force on the Site on the date the order is placed.
In accordance with European legislation on distance selling, you have 14 days from receipt of your order to exercise your right of withdrawal, without providing any reason.
The maximum delivery period is 28 business days from confirmation of your order.
Article 1 - Scope
These General Terms and Conditions of Sale apply, without restriction or reservation, to all distance sales concluded by the Seller with Customers wishing to purchase the Products offered for sale by the Seller on the website accessible at the following web address: www.10lapuff.com
Customers are consumers, defined as natural persons acting for private purposes and therefore outside the scope of any commercial, industrial, craft, professional or agricultural activity, who wish to make a purchase on the Site. However, in accordance with Article L. 3512-12 of the French Public Health Code, undertakes not to sell electronic vaping devices or associated refill bottles to minors under eighteen (18) years of age.
These Terms and Conditions are accessible at any time on the site and shall prevail over any other document. The Customer declares that they have read and accepted these Terms and Conditions by ticking the box provided for this purpose before the online ordering procedure on the Site is implemented. Any order confirmation automatically entails acceptance of these terms (see Article 3 – Orders).
Unless proven otherwise, the data recorded in the Seller’s computer system constitute proof of all transactions concluded with the Customer. For faster processing, 10lapuff communicates primarily and systematically by email.
Pursuant to Article L. 111-4 of the French Consumer Code, 10lapuff informs the Customer, on any suitable medium before the conclusion of the sale, of the various periods during which, or the date until which, spare parts essential for using the product are available on the market, provided that these details have actually been communicated to it by the manufacturer, supplier or importer. This information, when known to the Seller, will be displayed and will enable the Customer to place their order with full knowledge of the relevant information. The Products available on the Site are offered for sale in the territories in accordance with the standards of the relevant carriers. As a general rule, these standards are based on the European legislation in force, in accordance with the respective terms and conditions of the partner carriers.
The regulations applicable to distance selling in a country outside metropolitan France may differ from these terms and conditions. For all Products shipped outside the European Union and the overseas departments and territories, the price will be automatically calculated excluding taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These shall be borne by and shall be the sole responsibility of the Customer.
Responsibility of foreign customers
It is the responsibility of our foreign customers to verify the laws and regulations in force in their country concerning the importation of products purchased on our site. E Solution Trade shall not be held liable for any customs seizure or other legal issue resulting from the products’ non-compliance with local laws and regulations. We strongly recommend that our customers consult the competent authorities before finalizing their order.
Article 2 – Prices
The Products are supplied at the prices in effect shown on the Site when the Seller records the order. Prices are expressed in euros, including all taxes. The prices take into account any discounts that may be granted by the Seller on the Site.
These prices are firm and non-revisable during their validity period, but the Seller reserves the right to modify them at any time outside that validity period.
Prices do not include processing, shipping, transportation, and delivery costs, which are charged in addition under the conditions indicated on the Website and calculated before the order is placed.
The payment requested from the Customer corresponds to the total purchase amount, including these costs.
For environmental reasons, the Seller does not issue an invoice to the Customer upon delivery of the ordered Products. However, the Customer may print it themselves from their customer account:
- The Customer logs into their customer account using the previously used credentials, which must be kept strictly confidential;
- The Customer goes to the “Order History and Details” section;
- For the order in question, the Customer clicks the invoice icon;
- The invoice is displayed in PDF format in a new tab, and the Customer only needs to click the “Printer” button to print it.
Article 3 – Product Characteristics – Orders
The Products offered for sale on the Website are described in a manner enabling the Customer to know their main characteristics, including the specifications, illustrations, delivery times and indications of the dimensions or capacity of the Products, as well as their price. The Customer must review this information before placing any order. The selection and purchase of a Product are the sole responsibility of the Customer. The photographs and graphics presented on the Website are not contractual and shall not incur the publisher’s liability.
The pre-contractual and contractual information is presented in French and is confirmed no later than when the Customer validates the order.
Upon entering the Website, the Customer declares that they are of legal age and are not subject to any guardianship or curatorship preventing them from being able to enter into this contract.

They must choose a password in accordance with the procedures set out in the explanations provided on the same page. This action will result in an email being sent to the email address provided, requesting confirmation of that email address. The account is created upon this confirmation, and a page will appear confirming that the new customer area has been properly created;
- The customer area created and/or opened enables the Customer to benefit from loyalty pots and add them to their order, where the loyalty pot is available and/or credited:

They accept these Terms and Conditions of Sale, acknowledge that they are of legal age (under the legislation of their country) and are authorized under that same legislation to purchase vaping products and products containing nicotine by ticking the boxes provided for this purpose.
The sale shall be deemed concluded only after full payment of the price. The Customer is responsible for verifying the accuracy of the order and immediately reporting any error. Any order placed on the Site constitutes the formation of a distance contract between the Customer and the Seller. Orders must be paid in €uros, in full and in cash. At no time may the amounts paid be considered as deposits, down payments, or any other advance payment. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to payment of a previous order. The Customer may track the progress of their order on the Site. Once confirmed and accepted by the Seller under the conditions described above, the order may not be modified.
Article 4 – Customer area – account
To place an order, the Customer is invited to create an account (personal area). To do so, they must register by completing the form provided at the time of ordering and undertake to provide truthful and accurate information concerning their civil status and contact details, including their email address, telephone number (if provided), and the various delivery and billing addresses.
The publisher reminds Customers of the importance of all this information, particularly information concerning the Customers’ legal age. The Customer is responsible for updating the information provided. The Customer is informed that they may modify it by logging into their account. To access their personal area and order histories, the Customer must identify themselves using their username and password, which will be provided after registration and are strictly personal.
Accordingly, the Customer undertakes not to disclose it. Otherwise, the Customer shall remain solely responsible for the use made thereof. The Customer may also request to unsubscribe by visiting the dedicated page in their personal account or by sending an email to store10lapuff@gmail.com This shall take effect within a reasonable period. In the event of non-compliance with the general terms and conditions of sale and/or use, the Site publisher may suspend or even close a customer’s account after formal notice has been sent electronically and remained without effect.
Any deletion of an account, whatever the reason, shall result in the outright deletion of all of the Customer’s personal information. Any event resulting from a force majeure event that causes the website or server to malfunction, subject to any interruption or modification in the event of maintenance, shall not engage the Seller’s liability.
Creating an account entails acceptance of these General Terms and Conditions of Sale.
Article 5 – Payment terms
The price is paid through a secure payment system, by bank card or PayPal. For payment by bank card, the card is not charged until the order is dispatched. Payment data is exchanged in encrypted form using the protocol defined by the approved payment service provider handling the banking transactions carried out on the Site. Payments made by the Customer shall be considered final only after the Seller has effectively received the amounts due.
The Seller shall not be required to deliver the Products ordered by the Customer if the Customer has not paid the full price thereof under the conditions indicated above.
Article 6 – Deliveries
The products ordered by the Customer will be delivered in accordance with the standards applicable to our partner carriers. Any order may be dispatched the same day, provided that the products are actually in available stock, or within a maximum of 72 hours, except in the event of a manufacturer's or one of our suppliers' stock shortage, and also in cases of force majeure (see Article 7)
Deliveries are generally made within 48 hours (without guarantee) to the address indicated by the Customer when placing their order on the website. Delivery is deemed to occur upon the transfer to the Customer of physical possession or control of the Product. Except in special circumstances or where one or more Products are unavailable, the Products ordered will be delivered in a single shipment. The Seller undertakes to use its best efforts to deliver the products ordered by the Customer within the time limits specified above. If the Seller's supplier is unable to supply a product, the Customer will be offered the option of exchanging the ordered product for an equivalent product in terms of quality, characteristics and price. If the Products ordered have not been delivered within 30 (THIRTY) days after the indicative delivery date, for any reason other than force majeure or the Customer's actions, the sale may be terminated at the Customer's written request under the conditions set out in Articles L. 216-2, L. 216-3 and L. 241-4 of the French Consumer Code. The amounts paid by the Customer will then be refunded within the days following the date of termination of the contract, with no compensation or deduction. Deliveries are made by an independent carrier to the address provided by the Customer when placing the order and to which the carrier can easily gain access.
Where the Customer has itself arranged for a carrier of its own choosing, different from the carriers offered on the Website, delivery shall be deemed to have been completed upon the Seller's handover of the ordered Products to the carrier, which accepted them without reservation. The Customer therefore acknowledges that it is the carrier's responsibility to effect delivery and that the Customer has no recourse against the Seller under any guarantee in the event of failure to deliver the transported goods. In the event of a specific request by the Customer concerning the packaging or transport conditions for the ordered products, duly accepted in writing by the Seller, the related costs shall be invoiced separately, based on a quotation previously accepted in writing by the Customer.
The Customer is required to verify the condition of the delivered products. The Customer has a period of 30 (THIRTY) days from delivery (excluding the carrier's response time) to submit complaints by email, accompanied by all relevant supporting documents, particularly photographs. After this period and if these formalities have not been complied with, the Products shall be deemed compliant and free from any apparent defect, and no complaint may be validly accepted by the Seller. The Seller shall refund or replace, as soon as possible and at its own expense, the delivered Products whose lack of conformity or apparent or latent defects have been duly proven by the Customer, under the conditions set out in Articles L. 217-4 et seq. of the Consumer Code and those set out in these General Terms and Conditions of Sale. The transfer of the risks of loss and damage relating thereto shall occur only when the Customer physically takes possession of the Products. The Products therefore travel at the risk of the designated and selected transport partners, except where the Customer has chosen the carrier itself.
In this respect, the risks shall be transferred upon delivery of the goods to the carrier. When performance of the contract proceeds as mentioned above and except in the event of unforeseen circumstances or force majeure, the Seller shall reimburse the Customer for all amounts paid no later than fifteen (15) days following the date on which the contract was terminated. The amount reimbursed by the Seller to the Customer, based on the amount paid by the Customer, shall automatically be increased by 10% if the reimbursement occurs no later than 30 (THIRTY) days after the due date, by 20% up to 60 (SIXTY) days, and by 50% thereafter.
Article 7 – Hardship - Force majeure
It is specified that, in the event of unforeseeable changes in circumstances at the time of conclusion of the contract, in accordance with the provisions of Article 1195 of the Civil Code, the Party that has not agreed to assume the risk of excessively onerous performance may request that its contracting party renegotiate the contract.
If a case of force majeure occurs that prevents it from performing its obligations, the contract shall be immediately suspended from the date on which either party gives notice by any possible written means of communication. Likewise, the party concerned by this article shall inform the other party when the event has ceased, and the contract shall resume performance immediately on the date of that communication.
Force majeure means any event making performance impossible or manifestly more difficult due to the unforeseeable, irresistible or external nature of that event. These three criteria may be considered separately; events such as wars, terrorist attacks, epidemics, riots, the imposition of a state of emergency, fires, floods, total or partial strikes, paralysis of road or other transport routes, interruptions in the supply of energy (EDF, GDF, oil, etc.), blockages of telecommunications and computer networks, delays or failures within the area of competence of external partners, such as suppliers, service providers or subcontractors, are taken into account. This list is in no way exhaustive, and the situation shall remain subject to the Seller’s assessment.
Article 8 – Transfer of title
Title to the Products shall not pass from the Seller to the Customer until the price has been paid in full by the latter, regardless of the delivery date of the said Products.
Article 9 – Right of withdrawal
In accordance with the provisions of Article L. 221-18 of the Consumer Code:
“The consumer has a period of fourteen (14) days to exercise their right of withdrawal from a distance contract, following telephone canvassing or concluded off-premises, without having to state reasons for their decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25.
The period referred to in the first paragraph runs from the day:
1) From the conclusion of the contract, for contracts for the provision of services and those referred to in Article L. 221-4;
2) Upon receipt of the goods by the consumer or by a third party, other than the carrier, designated by the consumer, for sales contracts. For contracts concluded off-premises, the consumer may exercise their right of withdrawal from the conclusion of the contract. In the case of an order for several goods delivered separately or an order for a good consisting of multiple batches or parts whose delivery is staggered over a defined period, the period runs from receipt of the last good, batch or part. For contracts providing for the regular delivery of goods during a defined period, the period runs from receipt of the last delivery.”
However, in accordance with the provisions of Article L. 211-28 of the Consumer Code:
“The right of withdrawal may not be exercised for contracts: (…)
3° The supply of goods made to the consumer's specifications or clearly personalised;
4° The supply of goods liable to deteriorate or expire rapidly;
5° The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;
6° The supply of goods which, after having been delivered and by their nature, become inseparably mixed with other items; (...)
The right of withdrawal must be exercised by sending an email using the withdrawal form appearing in the Appendix to these General Terms and Conditions of Sale and also available on the Site, completed in full and unambiguously expressing the wish to withdraw, sent to the Seller at the contact details indicated in Article 1 of these General Terms and Conditions of Sale. Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.), enabling them to be resold as new, together with the purchase invoice. Damaged, soiled or incomplete Products will not be accepted for return. Return costs shall remain payable by the Customer. The exchange (subject to availability) or refund shall be made within 14 (FOURTEEN) days from the date on which the Seller receives the Products returned by the Customer under the conditions set out in this Article.
Article 10 - Seller's Liability - Warranties
The Customer is responsible for checking the goods received upon delivery. Any claim, reservation and/or dispute relating to apparent defects and lack of conformity must be made within 2 (TWO) days following delivery. In the event of proven apparent defects or lack of conformity, the defective or non-conforming products will be replaced (subject to verification; see Article 9). A warranty refund may not be requested under conditions of use and/or performance not provided for (see Article 9).
ISFAX TECHNOLOGY LIMITED shall take back free of charge used electrical and electronic equipment that the Customer no longer uses, subject to the quantity and type of equipment sold. The Seller encourages the Customer to take this electrical and electronic equipment, which they no longer use, to a waste collection centre.
10LAPUFF may refuse to take back electrical or electronic equipment that, following contamination or any other action, may pose a health or safety risk to the company's personnel, whether or not they are responsible for taking back the equipment. This assessment will be carried out when the equipment in question is deposited, based on the determination that conventional personal protective equipment or other standard packaging methods cannot prevent any risk whatsoever. In such a case, 10LAPUFF shall inform the Customer of the reasoned refusal and of alternative take-back solutions.
To enforce their rights, the Customer must inform the Seller in writing (by email) of the Products’ lack of conformity or the existence of hidden defects as soon as they are discovered. The Seller shall refund, replace or arrange for the repair of Products or parts covered by warranties that are found to be non-conforming or defective. Shipping costs shall be refunded on the basis of the amount charged, and return costs shall be refunded upon presentation of supporting documents. Refunds, replacements or repairs of Products found to be non-conforming or defective shall be carried out as soon as possible and no later than 30 days following the Seller’s confirmation of the lack of conformity or hidden defect. This refund may be made by bank transfer or cheque.
The Seller’s liability shall not be incurred in the following cases:
- Failure to comply with the legislation of the country to which the products are delivered, which the Customer is responsible for verifying,
- In the event of improper use, use for professional purposes, negligence or failure by the Customer to maintain the Product, as well as in the event of normal wear and tear of the Product, accident or force majeure.
- The photographs and graphics presented on the website are not contractual and shall not incur the Seller’s liability.
In any event, the company disclaims all liability, particularly with regard to the Customer(s)’ choice of products and, above all, any modifications that may have been made to them or improper use contrary to the product usage recommendations.
Furthermore, the company is designated as the Seller and, in this capacity, is not the producer, within the meaning of Articles 1245 et seq. of the French Civil Code, of the products marketed on the website. Consequently, its liability cannot and shall not be incurred in the event of damage caused to property and/or persons due to a defect in the products within the meaning of the aforementioned articles. A Customer wishing to obtain compensation for such damage must therefore contact the supplier and/or manufacturer concerned and seek to establish the latter’s liability. In any event, the Seller’s warranty is limited to replacing or refunding Products that do not conform or are affected by a defect.
Provisions relating to statutory warranties
- Article L. 214-4 of the French Consumer Code : “The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. This period shall run from the buyer's request for intervention or from the date on which the item concerned is made available for repair, if that date is later than the request for intervention.”
- Article 1641 of the Civil Code : “The Seller is liable under the warranty for latent defects in the item sold that render it unfit for the use for which it is intended, or that so impair that use that the buyer would not have purchased it, or would have paid only a lower price, had they known of them.”
