General Terms and Conditions of Sale
Preamble - Purpose of these General Terms and Conditions of Sale
The Seller ( ISFAX TECHNOLOGY ) publishes and operates a website accessible at the Web address www.10lapuff.com
(hereinafter the “Site”).
The Products are offered for sale on the Site to non-professional buyers and are as follows: electronic cigarettes, e-liquids and associated products.
These General Terms and Conditions of Sale (hereinafter the “General Terms and Conditions of Sale”) describe the terms and conditions for the distance sale of products offered for sale (the “Products”) between Sellers and non-professional buyers (the “Customers” or the “Customer”), through the aforementioned Website, and define the obligations and rights of the Parties in this respect.
The fact that the Customer places an order on the Internet Site www.10lapuff.com constitutes full and unconditional acceptance of these General Terms and Conditions of Sale, which the Customer expressly acknowledges, waiving, in particular, the right to rely on any contradictory document that would therefore be unenforceable against ISFAX TECHNOLOGY LIMITED.
These General Terms and Conditions of Sale are accessible at any time on the Site and shall prevail, where applicable, over any other version or any other contradictory document. As these General Terms and Conditions of Sale may be amended subsequently, the version applicable to the Customer's purchase is the version in force on the Site on the date the order is placed.
Article 1 – Scope
These General Terms and Conditions of Sale apply, without restriction or reservation, to all distance sales concluded by the Seller with Customers wishing to purchase the Products offered for sale by the Seller on the website accessible at the following Web address: www.10lapuff.com
Customers are consumers, defined as natural persons acting for private purposes and therefore not engaged in a commercial, industrial, craft, professional or agricultural activity, who wish to make a purchase on the Site. However, in accordance with the provisions of Article L. 3512-12 of the French Public Health Code, undertakes not to sell electronic vaping devices or associated refill bottles to minors under eighteen (18) years of age.
These General Terms and Conditions of Sale are accessible at any time on the Site and shall prevail over any other document. The Customer declares that they have read and accepted these General Terms and Conditions of Sale by ticking the box provided for this purpose before initiating the Site's online ordering procedure. Any order validation entails, de facto, acceptance of these terms and conditions (see Article 3 - Orders).
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer. For reasons of processing speed, 10lapuff communicates systematically and primarily by email.
Pursuant to Article L. 111-4 of the French Consumer Code, 10lapuff informs the Customer, on any suitable medium before the conclusion of the sale, of the various periods during which, or the date until which, spare parts essential to the use of the product are available on the market, provided that this information has actually been supplied to it by the manufacturer, supplier or importer. This information, when known to the Seller, will be displayed and will enable the Customer to place their order with full knowledge of the circumstances. The Products available on the Site are offered for sale in the territories in accordance with the standards of the relevant carriers. As a general rule, the standards are based on the applicable European legislation, in accordance with the respective terms and conditions of the partner carriers.
The regulations applicable to distance selling in a foreign country other than mainland France may differ from these terms and conditions. For all Products shipped outside the European Union and the French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. They shall be borne by and be the sole responsibility of the Customer.
Article 2 - Prices
The Products are supplied at the prices in force displayed on the Site when the Seller records the order. Prices are expressed in Euros, including all taxes. The prices take into account any discounts granted by the Seller on the Site.
These prices are firm and non-revisable during their period of validity, but the Seller reserves the right to change them at any time outside that period.
The prices do not include processing, shipping, transport, and delivery costs, which are invoiced in addition under the conditions indicated on the Site and calculated before the order is placed.
The payment requested from the Customer corresponds to the total purchase amount, including these costs.
For environmental reasons, the Seller does not issue an invoice to the Customer upon delivery of the ordered Products. However, the Customer may print it themselves from their customer account:
- The Customer logs in to their customer account using the previously used credentials, which must be kept strictly confidential;
- The Customer goes to the “Order history and details” section;
- For the order in question, the Customer clicks the invoice icon;
- The invoice is displayed in PDF format in a new tab, and the Customer only has to click the “Printer” button to print it.
Article 3 – Product Characteristics – Orders
The Products offered for sale on the Site are accompanied by a description enabling the Customer to ascertain their main characteristics, including the specifications, illustrations, delivery times, and information on the dimensions or capacity of the Products, as well as their price. The Customer is required to read this information before placing any order. The selection and purchase of a Product are the sole responsibility of the Customer. The photographs and graphics presented on the Site are not contractual and shall not incur the publisher's liability.
The pre-contractual and contractual information is presented in French and is confirmed no later than when the Customer validates the order.
Upon entering the Site, the Customer declares that they are of legal age and are not under any guardianship or curatorship preventing them from being able to enter into this contract.
Product offers are valid as long as they are visible on the Site, subject to availability. The Customer is responsible for selecting on the Site the Products they wish to order, in accordance with the following procedures:
- The Customer selects the quantity of products and then clicks on the button « I buy » ;
- The floating basket opens and the Customer may continue shopping or click on the button « Basket » if they wish to finalise their current order;
- The Customer may benefit from any available discount vouchers by entering their references in the field provided for this purpose and clicking on the button « Add ». The new price will then be displayed to inform the Customer that it has been properly taken into account. To find out the delivery costs, the Customer first clicks on the button « Confirm order », and will then have access to an estimate of the delivery costs on the right, provided for information purposes;
- If the Customer is registered, they log in by entering their email address and password (confidential), then click on the button « Log in » ;
- If not yet registered, the Customer must create an account. To do so, they must provide a valid email address and click on « Create my account ». The Customer must then provide a certain amount of information (see Article 4). If the Customer does not complete all mandatory fields marked with an asterisk, their registration cannot be taken into account. They must choose a password in accordance with the procedures set out in the explanations provided on the same page. This action will result in an email being sent to the email address provided, requesting confirmation of that email address. The account will be created upon confirmation, and a page will appear confirming that the new customer account has been properly registered;
- The customer account created and/or opened enables the Customer to benefit from loyalty pots and add them to their order, where the pot is available and/or credited:
- The Customer chooses their delivery and billing address. The Customer may update and/or create new addresses. The Customer undertakes to ensure the accuracy of the information provided (see Article 4). The Customer then clicks "Continue" ;
- The Customer chooses the transport arrangements and takes note of the final cost thereof. To pay for their order, the Customer then clicks the button "Continue" ;
- The Customer chooses their payment method, makes the payment, and confirms their order by clicking the button "Order with payment obligation". They accept these GTCs, acknowledge that they are of legal age (under the legislation of their country), and that they are authorized under that same legislation to purchase vaping products and products containing nicotine by checking the boxes provided for this purpose.
The sale shall be deemed concluded only after full payment of the price. The Customer is responsible for verifying the accuracy of the order and immediately reporting any error. Any order placed on the Site constitutes the formation of a distance contract between the Customer and the Seller. Orders must be paid in €uros, in full and in cash. At no time may the amounts paid be considered earnest money, deposits, or any other advance payment. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to payment for a previous order. The Customer may track the progress of their order on the Site. Once confirmed and accepted by the Seller under the conditions described above, the order may not be modified.
Article 4 - Customer area - account
To place an order, the Customer is invited to create an account (personal area). To do so, they must register by completing the form provided at the time of their order and undertake to provide truthful and accurate information concerning their civil status and contact details, in particular their email address, telephone number (if provided), and the various delivery and billing addresses.
The operator reminds Customers of the importance of all this information, in particular information relating to the Customers’ legal age. The Customer is responsible for updating the information provided. The Customer is informed that this information may be amended by logging into their account. To access their personal area and order histories, the Customer must identify themselves using their username and password, which will be provided after registration and are strictly personal.
Accordingly, the Customer undertakes not to disclose it. Otherwise, the Customer shall remain solely responsible for its use. The Customer may also request to unsubscribe by visiting the dedicated page in their personal area or by sending an email to store10lapuff@gmail.com This shall take effect within a reasonable period. In the event of non-compliance with the General Terms and Conditions of Sale and/or Use, the Site operator may suspend or even close a customer’s account after a formal notice has been sent electronically and has remained without effect.
Any deletion of an account, whatever the reason, shall result in the outright deletion of all of the Customer’s personal information. Any event attributable to force majeure resulting in a malfunction of the site or server, and subject to any interruption or modification in the event of maintenance, shall not render the Seller liable.
The creation of an account entails acceptance of these General Terms and Conditions of Sale.
Article 5 – Payment Terms
The price shall be paid by secure payment, by bank card or PayPal. For payment by bank card, the card shall only be charged when the order is dispatched. Payment data are exchanged in encrypted form using the protocol established by the approved payment service provider handling the banking transactions carried out on the Site. Payments made by the Customer shall be considered final only after the Seller has effectively received the sums due.
The Seller shall not be required to deliver the Products ordered by the Customer if the Customer has not paid the full price thereof under the conditions indicated above.
Article 6 – Delivery
The products ordered by the Customer shall be delivered in accordance with the standards applicable to our partner carriers. Any order may be dispatched the same day, provided that the products are actually in available stock, or within a maximum of 72 hours, except in the event of a stock shortage on the part of a manufacturer or one of our suppliers, and also in the event of force majeure (see Article 7)
Deliveries are in principle made within 48 hours (without guarantee) to the address indicated by the Customer when placing the order on the website. Delivery consists of transferring physical possession or control of the Product to the Customer. Except in special cases or where one or more Products are unavailable, the Products ordered shall be delivered in a single shipment. The Seller undertakes to use its best efforts to deliver the products ordered by the Customer within the deadlines specified above. If the Seller's supplier is unable to supply a product, the Customer will be offered the option of exchanging the product ordered for an equivalent product in terms of quality, characteristics and price. If the Products ordered have not been delivered within 30 (THIRTY) days after the indicative delivery date, for any reason other than force majeure or the Customer's actions, the sale may be terminated at the Customer's written request under the conditions set out in Articles L. 216-2, L. 216-3 and L. 241-4 of the French Consumer Code. The sums paid by the Customer shall then be refunded within the days following the date of termination of the contract, to the exclusion of any compensation or deduction. Deliveries are made by an independent carrier to the address provided by the Customer when placing the order and to which the carrier can readily gain access.
Where the Customer has independently arranged for a carrier of their own choosing, different from the carriers offered on the Website, delivery shall be deemed to have been completed as soon as the Seller hands over the Products ordered to the carrier, who has accepted them without reservation. The Customer therefore acknowledges that it is the carrier's responsibility to carry out the delivery and shall have no recourse under any warranty against the Seller in the event of failure to deliver the goods transported. In the event of a specific request by the Customer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Seller, the related costs shall be invoiced separately in addition, based on a quotation previously accepted in writing by the Customer.
The Customer is required to inspect the condition of the delivered products. The Customer has a period of 30 (THIRTY) days from delivery (excluding the carrier’s response time) to submit claims by email, accompanied by all relevant supporting documents, particularly photographs. After this period, and in the absence of compliance with these formalities, the Products shall be deemed compliant and free from any apparent defect, and no claim may be validly accepted by the Seller. The Seller shall reimburse or replace, as soon as possible and at its own expense, the delivered Products whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in Articles L. 217-4 et seq. of the French Consumer Code and those set forth in these General Terms and Conditions of Sale. The transfer of the risks of loss and deterioration relating thereto shall take place only when the Customer physically takes possession of the Products. The Products therefore travel at the risk and peril of the designated and selected transport partners, except where the Customer has itself selected the carrier.
In this respect, the risks shall be transferred upon delivery of the goods to the carrier. When the contract is performed as mentioned above and except in the event of unforeseen circumstances or force majeure, the Seller shall reimburse the Customer for all amounts paid no later than fifteen (15) days following the date on which the contract was terminated. The amount reimbursed by the Seller to the Customer, based on the amount paid by the Customer, shall automatically be increased by 10% if the reimbursement occurs no later than 30 (THIRTY) days after the due date, by 20% up to 60 (SIXTY) days, and by 50% thereafter.
Article 7 – Unforeseeability - Force majeure
It is specified that, in the event of a change in circumstances that was unforeseeable at the time the contract was entered into, in accordance with the provisions of Article 1195 of the French Civil Code, the Party that did not agree to assume the risk of excessively burdensome performance may request that its co-contracting party renegotiate the contract.
In the event of force majeure preventing the performance of its obligations, the contract shall be immediately suspended as of the date on which one of the parties gives notice by any possible written means of communication. Likewise, the party concerned by this article shall inform the other party when the event has ceased, and the contract shall resume performance immediately on the date of such communication.
Force majeure means any event that renders performance impossible or manifestly more difficult due to the unforeseeable, irresistible or external nature of that event. These three criteria may be considered separately; events such as wars, terrorist attacks, epidemics, riots, the declaration of a state of emergency, fires, floods, total or partial strikes, paralysis of road or other transport routes, interruptions in the supply of energy (EDF, GDF, oil, etc.), disruptions to telecommunications and computer networks, delays or failures within the scope of the competence of external partners, such as suppliers, service providers or subcontractors, shall be taken into account. This list is in no way exhaustive, and the situation shall remain at the Seller’s discretion.
Article 8 – Transfer of title
Title to the Seller’s Products shall pass to the Client only after the price has been paid in full by the latter, regardless of the delivery date of those Products.
Article 9 – Right of withdrawal
In accordance with the provisions of Article L. 221-18 of the Consumer Code:
“The consumer has a period of fourteen (14) days to exercise the right of withdrawal from a distance contract, following telephone solicitation or concluded off-premises, without having to give reasons for the decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25.
The period referred to in the first paragraph shall run from the day:
1°) From the conclusion of the contract, for contracts for the supply of services and those referred to in Article L. 221-4;
2°) From receipt of the goods by the consumer or by a third party, other than the carrier, designated by the consumer, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise the right of withdrawal from the conclusion of the contract. In the case of an order for several goods delivered separately, or in the case of an order for a good consisting of multiple lots or parts whose delivery is staggered over a defined period, the period shall run from receipt of the last good or lot, or of the last part. For contracts providing for the regular delivery of goods over a defined period, the period shall run from receipt of the last delivery.”
However, pursuant to the provisions of Article L. 211-28 of the French Consumer Code:
“The right of withdrawal may not be exercised for contracts: (…)”
3° The supply of goods made to the consumer's specifications or clearly personalized;
4° The supply of goods liable to deteriorate or expire rapidly;
5° The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
6° The supply of goods which, after having been delivered and by their nature, become inseparably mixed with other items; (…)»
The right of withdrawal must be exercised by sending an email, using the withdrawal form set out in the Annex to these GTC and also available on the Site, completed in full and unambiguously expressing the wish to withdraw, to the Seller at the contact details indicated in Article 1 of these GTC. Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.), allowing them to be resold as new, together with the purchase invoice. Damaged, soiled or incomplete Products will not be accepted for return. Return costs remain payable by the Customer. The exchange (subject to availability) or refund will be made within 14 (FOURTEEN) days from the date on which the Seller receives the Products returned by the Customer under the conditions provided for in this article.
Article 10 - Seller's Liability - Warranties
The Customer is responsible for checking the goods received upon delivery. Any complaint, reservation and/or dispute relating to apparent defects and lack of conformity must be made within 2 (TWO) days following delivery. In the event of proven apparent defects or lack of conformity, the defective or non-conforming products will be replaced (subject to verification; see Article 9). A refund under the warranty may not be requested under conditions of use and/or performance not provided for (see Article 9).
ISFAX TECHNOLOGY shall take back, free of charge, used electrical and electronic equipment that the Client no longer uses, subject to the quantity and type of equipment sold. The Seller encourages the Client to take such electrical and electronic equipment that they no longer use to a waste collection centre.
10LAPUFF may refuse to take back electrical or electronic equipment which, following contamination or any other action, may pose a health or safety risk to the company's personnel, whether or not they are responsible for taking back the equipment. This assessment shall be made when the equipment in question is deposited, based on the determination that conventional personal protective equipment or other standard packaging methods cannot prevent the slightest risk. In such a case, 10LAPUFF shall inform the Client of the reasoned refusal and the alternative take-back solutions.
In order to assert their rights, the Client must inform the Seller in writing (by email) of the non-conformity of the Products or the existence of hidden defects as soon as they are discovered. The Seller shall refund, replace or arrange for the repair of Products or parts covered by warranties that are deemed non-conforming or defective. Shipping costs shall be refunded on the basis of the amount charged, and return costs shall be refunded upon presentation of supporting documents. Refunds, replacements or repairs of Products deemed non-conforming or defective shall be carried out as soon as possible and no later than 30 days following the Seller's determination of the lack of conformity or hidden defect. This refund may be made by bank transfer or cheque.
The Seller's liability shall not be incurred in the following cases:
- Failure to comply with the legislation of the country to which the products are delivered, which it is the Client's responsibility to verify,
- In the event of improper use, use for professional purposes, negligence or lack of maintenance on the part of the Client, as well as normal wear and tear of the Product, accident or force majeure.
- The photographs and graphics presented on the website are not contractually binding and shall not incur the Seller's liability.
In any event, the company disclaims all liability, particularly with regard to the Client's choice of products and, above all, any modifications that may have been made to them or improper use contrary to the product usage recommendations.
In addition, the company is designated as the Seller and, in this capacity, is not the producer, within the meaning of Articles 1245 et seq. of the Civil Code, of the products marketed on the website. Consequently, its liability cannot and shall not be incurred in the event of damage caused to property and/or persons due to a defect in the products within the meaning of the aforementioned articles. The Client wishing to obtain compensation for such damage must therefore contact the supplier and/or manufacturer concerned and seek to establish the latter’s liability. In any event, the Seller’s warranty is limited to replacing or refunding Products that do not conform or are affected by a defect.
Provisions relating to legal warranties
- Article L. 214-4 of the French Consumer Code : “The seller is required to deliver property that conforms to the contract and is liable for any lack of conformity existing at the time of delivery. - if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or the producer’s representative, particularly in advertising or labelling;
- Or if it has the characteristics agreed upon by the parties or is suitable for any specific use sought by the buyer, brought to the seller’s attention and accepted by the seller.”
- Article L. 217-12 of the French Consumer Code : “An action resulting from a lack of conformity is time-barred two years from delivery of the property.”

This period runs from the buyer’s request for intervention or from the date on which the property concerned is made available for repair, if that date is later than the request for intervention.”
- Article 1641 of the French Civil Code : « The Seller is liable under the warranty for latent defects in the item sold that render it unfit for the use for which it is intended, or that so diminish that use that the buyer would not have acquired it, or would have paid only a lower price for it, had the buyer known of them. »
- Article 1648, paragraph 1st of the French Civil Code: « An action based on redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
